Which entities are covered

Undertakings carrying out the manufacture of substances and the distribution of substances or mixtures, and undertakings carrying out the production of articles from substances or mixtures.

Sub-sectors named in the annex

  • Manufacture, production and distribution of chemicals

Scope traps specific to this sector

Trap 1

Distribution is covered, not only manufacture — chemical distributors are in scope.

Trap 2

Seveso III sites face parallel obligations that address physical safety, not cybersecurity, so neither regime substitutes for the other.

What else applies to you

REACH; Seveso III (Directive 2012/18/EU) for major accident hazards.

NIS2 rarely arrives alone. Where another EU act covers the same ground and is at least equivalent in effect, article 4 disapplies the corresponding NIS2 provisions — but only those, and only where that test is met.
