NIS2 for Space
Narrow but new. The scope is the ground segment, not the spacecraft, which surprises operators who assumed the directive stopped at the atmosphere.
Which entities are covered
Operators of ground-based infrastructure, owned, managed and operated by member states or private parties, that support the provision of space-based services, excluding providers of public electronic communications networks.
Sub-sectors named in the annex
- Operators of ground-based infrastructure supporting space-based services
Scope traps specific to this sector
Trap 1
The entry covers ground infrastructure supporting space-based services — teleports, control centres, ground stations.
Trap 2
Providers of public electronic communications networks are excluded here because they are already covered under digital infrastructure.
What else applies to you
The EU Space Programme Regulation; national space legislation.
NIS2 rarely arrives alone. Where another EU act covers the same ground and is at least equivalent in effect, article 4 disapplies the corresponding NIS2 provisions — but only those, and only where that test is met.
